1. Acceptance

By using Mixtura ("the Service"), you agree to these terms. If you don't agree, don't use the Service. We may update these terms — continued use means you accept changes.

2. What Mixtura Does

Mixtura is an AI-powered photo and video transformation platform. You upload photos and we use AI models to generate transformed versions — portraits, videos, stories, and other creative outputs.

3. Your Account

  • You must be at least 13 years old to use the Service
  • You are responsible for your account security
  • One account per person — no shared accounts
  • We can suspend or terminate accounts that violate these terms

4. Your Content

You own your photos. Uploading a photo to Mixtura does not transfer ownership to us.

Generated content: AI-generated outputs (images, videos, stories) created from your uploads are yours to use for personal and commercial purposes, subject to any restrictions from the underlying AI model providers.

License to us: By uploading content, you grant Mixtura a limited license to process, store, and display your content as needed to provide the Service (including on shared result pages).

5. Acceptable Use

You agree not to:

  • Upload photos of people without their consent for face swap features
  • Generate content that is illegal, harmful, or violates others' rights
  • Create deepfakes intended to deceive, harass, or defame
  • Generate CSAM or any content sexualizing minors
  • Use the Service to spam, phish, or distribute malware
  • Attempt to reverse-engineer, scrape, or abuse the Service
  • Circumvent usage limits or payment requirements
  • Impersonate others or misrepresent AI-generated content as real

We reserve the right to remove content and terminate accounts that violate these rules without notice.

6. Payments & Subscriptions

  • Free features are available without payment
  • Premium features require a paid subscription
  • Payments are processed securely by Stripe
  • Subscriptions auto-renew unless cancelled
  • Refunds are handled on a case-by-case basis — contact support
  • We may change pricing with 30 days' notice

7. AI-Generated Content Disclaimer

AI outputs may be unpredictable, imperfect, or unexpected. Generated content may not match your expectations. We do not guarantee specific results. AI models occasionally produce artifacts, distortions, or unintended outputs — this is inherent to the technology.

8. Availability

We strive for reliability but don't guarantee 100% uptime. The Service may be unavailable during maintenance, outages, or due to third-party service disruptions. We are not liable for losses caused by downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Mixtura is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Intellectual Property

The Mixtura name, logo, design, and underlying technology are our property. You may not copy, modify, or distribute our platform. User-generated content remains yours per Section 4.

11. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of Contra Costa County, California.
